Did you purchase owner’s title insurance? If so, they should be handling this problem for you. It’s the settlement agent’s job to make sure the deed gets recorded. What does your settlement agent say?

I was looking at the previous forums trying to find a similar situation as mine but I couldn’t find one with all the same issues, so I’m going to ask for advice.
My partner and I purchased a house two years ago and we want to sell it in order to move. We just found out through research that the property was never deeded to us, and acording to the recorder in our state (Oh), the previous owner (seller) is not listed, but is listed on the auditor’s site. Have been unsuccessful in contacting the seller and I am concerned we may never to get rid of this property.

Here’s what I’ve found out to date: The sales agent has moved to another state with no forwarding number, the original mortgage co. is no longer in operation, and the mortgage seems to be the only documentation linking me to this property. I’m going to my county records office Monday and see where it leads…I’m starting to doubt if the sale was even legal.

As far as the records show, the property still belongs to the previous owner. I’m currently looking for a working contact number in order to reach this person. Is it possible for them to take out a second mortgage on the property? I had an attorney look into my property and I was told that a second mortgage was taken out in the same year that I purchased the home and I didn’t do it.
