I am a mortgage person, not a financial advisor. No one can advise you to file bankruptcy with the little bit of information you have provided here. Filing bankruptcy should be used as a last resort because it will follow you and haunt you for years to come.

You should get some financial counseling. One of the letters you never received from your lender offered counseling to you. There are places that provide free financial counseling services. You should seek them out. Call your local Chamber of Commerce and ask for the name of one.

my house has been foreclosed can they take my tax return .no judgement has been made though the court .there is about a 15,000 difference in what i paid for it and what they are saying is the fair market value .i live in florida if that matters.

There are different types of foreclosures and the requirements will vary according to the type and the state. Your foreclosure papers should indicate whether or not the lender can come after you for any more money.

IMHO I do not see how the lender can come after your tax refund. BUT, I am not an attorney.

Read your foreclosure paperwork.

If you never received any papers, how did you find out that the mortgage company was going to foreclose on the property? Each state has laws as to how foreclosures work. You need to find out how your state laws work. But, you also need a copy of your foreclosure papers. If you threw them away, that was a bad thing to do. You should obtain another copy from the lender and read them very carefully as they will affect you for years to come.

all i ever received was a phone call telling me the date of foreclosure .Is bankruptcy my best option from here?
