While the bank might dispute this, if your easement is recorded before anything else, it’d sure be a strong claim so I’d say do it if you can get it cheap.

I have a chance to buy a lake lot, but it’s landlocked. The owner through which an easement and access would make sense is in foreclosure, already through sheriff’s sale phase, but bank is not on title yet, owner still is. I’m in a race state. Would an easement I buy across this soon-to-be (but not yet formally) bank-owned property be valid if I record it before the bank records whatever it needs to record to get on title?
