I’m not a lawyer and not in Cali. I would think the state licensing board would publish a list of what activities “non-licensed assistants” are allowed to perform. You might want to check that out.

To Whom it may: I am an investor in California, I am going to start doing short sales for brokers and agents I know I dont need to be a licensed agent to do this but some attorneys are saying they think i do need to be,can you shine a little light on this please.

Frankly none of us can answer your question because you don’t say what your specifically going to be doing and how your going to be doing it. And to what degree your involvement is to every party in the deal.

It is very easy to cross the line into licensed activity, so I would provide a completely detailed outline of your plan in writing to the California Real Estate Commissioner for his review and comments. Plus by doing it right you will avoid getting the broker into trouble. After all most of them are not that bright per my 43 years as a broker in California.

I remember years ago a group tried to avoid licensing through the use of powers of attorney with their lawyers approval of the idea. It looked good on paper but it cost them a bundle when the DRE got hold of it.

You don’t need a real estate license to buy properties for yourself. If you’re looking to put buyers and seller together (for a fee) you should just get your license.

OK but legaly I dont need to be licensed to do this work for a broker, as I see it and I have been told by an attorney I am doing a service for the broker/agent on behalf of the home owner just like a home inspection or any other service, I now understand that California is working on laws that will require a person to be licensed but as of now I can do it, however I am going to get licensed, as to make referal fee’s. Is this the way you read the law here in Califoria and thank you Natalie, sincerely Kevin
