Was your contract contingent upon the sale of their home? If so, then they do have an out based on that contingency.

we were scheduled for closing yesterday, the seller postponed the closing b/c they can not get in touch with the person THEY are buying a house from. they were supposed to have two closing on the same day.

can they back out of our deal if their deal does not go through?

I went through this situation and prevailed when I gave them a demand letter with three options. 1. Sell the home. 2. Buy out the contract for the sale price. 3. I sue you for three times the sales price. What option do you think they took? Number 1! This is buyers right with a binding contract.

A real buyer, with a real contract, can force the owner to sell as agreed.

Hi,

We signed a contract to purcahse a house and we closed the purchage yesterday. According to the contract, we are suppose to get the keys on Thursday noon. But they are now saying that they can’t move out until Friday. All arrangement for moving, electricity, cleaning, phone are lined up. I also need to get out of my current property on time. What are my rights and what can I do if I find thursday afternoon that they are still there.

Thanks, I really appreciate a response quickly.
