After 3 weeks now we got an estimate on taking out the carpet, sealing floors, replacing pad and putting the carpet back (steam clean and moving furniture too). If we don’t pony up he’s most likely going to sue…any fresh thoughts on if he has a case or not? We feel we have done nothing wrong…
In March of 2004 we sold our home. The buyer was aware we had cats and dogs. Throughout our negotions, we had agreed to purchase a home warranty for the buyer and he had paid for a dry rot/pest inspection which resulted in us having to spray for insects that were not existing but due to old wood under the home we had to. The inspection came up with the spray, vapor barrier replacement and a couple other minor changes which we completed for the sale of our home. Now two months after closing and moving in, the buyer is threatening to sue us because he doesn’t like the smell in the house (we had installed new carpet in October 2003), the shower and dishwasher leak and there was some water condensation under the house. None of these things were noted in the inspection a month prior to closing and we were not aware of any leaking at the time we move out. When changing the carpets there were hardwood floors underneath which were needing to be cleand and sealed because of damage to the floor. We did this per the instruction of the carpet layers. The house is over 50 years old and we are NOT the first owners. In the letter from the buyer he stated that we obviously took meticulous care of our home and knew about these issues and lied about them…
Does buyer have any recourse since the deal was closed two months ago?

I would ignore their letter. You had the home inspected, and purchased a warranty for them. As far as the smell, they had plenty of time to “smell” the house before signing the contract. Don’t let it get to you. If you didn’t know about the problems (other than the smell), then I wouldn’t worry about it. It sounds to me like you have done nothing wrong.
