No more than he would have against you if you sold for $70K MORE in an appreciating market.

Is there any legal recourse against a builder who within 2 years sells the same home I purchased from them for $70,000 less?

My Beef? My annual income does not equal the amount of my loss. My home has been on the market for almost 2 years without an offer despite my attempts to lower the price of my home by 20% to compete with the builder who comes up with clever ways to manipulate their price and are still selling in my development just without the markup they had before. They encourage buyers to use their lender who approved people that really should not have qualified & have since foreclosed on their home which has a direct correlation with the market decline. I had to move 2000 miles away and now am struggling to make 2 mortgage payments because I am trying to do the responsible thing. Remember builders do not have to appraise property values like the resale market does. So perhaps you have a better idea?

why do you think you might have a claim? markets go up and markets go down. and a lot of them have gone down in the past 2 years. the house I sold in Northern California in May 2005 had dropped 20% since then. Should the buyer sue me?

You might want to look into the case with Pulte Homes in Las Vegas where they gave refunds to a lot of buyers in a similar situation.
