That’s what I’d do. In fact I’d sue the board, and each member personally, just because I’m PO’d.

In January 2005 my home owners association hired a new management company. In feb I started getting billed for a past due balance on my account – a balance I was not aware of. The management company has no clue what the balance is for – they claim they just inherited the balance from the previous company. I have asked to have this removed from my account and asked that the board review the balance but nothing has happened. Now, every month the balance increases by $50.00 which they are charging as a late fee. It’s up to $450.00 now. At this point can I pay off the balance – to stop the accuring late fees – and then sue the board of directors in small claims court to get the money back? They absolutely refuse to answer my requests for more information about the charges and I suspect they don’t know what they are for either.
